Neobnb Terms and Conditions

Welcome to Neobnb. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Neobnb Inc. ("Neobnb," "we," "us," or "our"). By accessing the Neobnb app or website, you agree to comply with and be bound by these Terms.
1. The Neobnb Marketplace Service
Neobnb is an online marketplace that enables users to list, discover, and book spaces. We provide three distinct modes of operation:
- BNB Mode: Short-term stays (hourly, nightly, or weekly).
- Rent Mode: Medium to long-term residential or commercial leasing.
- Sell Mode: Real estate discovery and sales connections.
Important Disclaimer: Neobnb does not own, create, sell, resell, provide, control, manage, or offer any Listings. When users make or accept a booking/lease/sale, they are entering into a contract directly with each other. Neobnb is not a party to any contractual relationship between Users, nor is Neobnb a real estate broker, insurer, or landlord.
2. User Accounts & Verification
2.1 Registration
To access certain features, you must create a Neobnb account. You agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your credentials.
2.2 Verification (Safe & Trusted)
To maintain the integrity of our community, Neobnb may:
- Require government-issued identification for "Verified" status.
- Screen users against public records of criminal convictions or sex offender registrations where permitted by law.
- While we use these tools, Neobnb does not guarantee the identity or conduct of any User.
3. Specific Terms for Hosts, Landlords, and Sellers
If you list a space on Neobnb, you agree to:
- Accuracy: Provide honest descriptions, disclose all fees, and use actual photos of the property.
- Compliance: You are responsible for following all local laws, including zoning, permits, homeowners' association (HOA) rules, and tax obligations.
- Exclusivity of Payment: You must process all payments for Neobnb leads through the Neobnb platform. Attempting to bypass the platform to avoid fees is a material breach of these terms.
4. User Modes: Rules of Engagement
4.1 BNB Mode (Short-Term & Micro-bookings)
- Bookings: A booking is a limited license to enter and use the Host's property for the duration specified.
- Cancellations: Users are bound by the cancellation policy selected by the Host at the time of booking.
4.2 Rent Mode (Medium to Long-Term)
- Lease Agreements: Neobnb provides templates for digital contracts. These are tools only; Users should seek legal counsel for specific lease terms.
- Security Deposits: Deposits are held and released according to the specific terms of the individual lease agreement.
4.3 Sell Mode (Property Sales)
- Inquiries: Neobnb facilitates the connection between a potential Buyer and a Seller/Agent.
- Transactions: Any real estate sale is finalized outside of the Neobnb platform via escrow and legal title transfer services. Neobnb does not handle the transfer of property titles.
5. Fees and Payments
- Service Fees: Neobnb charges a service fee for the use of the platform. These fees are displayed before a booking or listing is finalized.
- Taxes: Neobnb may be required to collect and remit Occupancy Taxes or VAT in certain jurisdictions. Users are responsible for all other individual tax obligations.
- Refunds: Neobnb's "Guest Refund Policy" governs disputes regarding property quality or "not as described" claims.
6. Prohibited Conduct
You agree not to:
- Discriminate against any User based on race, religion, gender, sexual orientation, disability, or national origin.
- Use Neobnb for any illegal activity, including unauthorized parties or commercial use without Host consent.
- Contact a User for any purpose other than asking a question related to a listing or the use of the platform.
- Use automated scripts to "scrape" data from the platform.
7. Liability & Indemnification
7.1 Limitation of Liability
To the maximum extent permitted by law, Neobnb is not liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data, or goodwill, arising out of or in connection with these Terms or the use of the platform.
7.2 Release
You release Neobnb from all claims, demands, and damages (actual and consequential) of every kind arising out of disputes between Users.
8. Dispute Resolution & Arbitration
Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in the jurisdiction of [Insert City/Country], rather than in court. You waive your right to participate in a class-action lawsuit.
9. Termination
Neobnb reserves the right, in its sole discretion, to terminate your account or access to the platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other Users, Neobnb, or third parties.
10. Community Safety & Prohibited Conduct
To ensure Neobnb remains a premier destination for real estate, the following are strictly prohibited:
- Discrimination: Denying a stay or rental based on race, religion, sex, or disability.
- Off-Platform Payments: Negotiating fees outside the app to avoid service charges.
- Misrepresentation: Using "stock" photos or misleading descriptions for listings.
- Illegal Activity: Using spaces for unauthorized commercial activity or illegal gatherings.
